How Is It Legal?
Thanks to the 2018 Farm Bill, THC derived from hemp plants is federally legal. At Trojan Horse, we extract our THC from hemp, allowing us to offer real cannabis edibles that are fully compliant with state and federal laws.
Hemp vs. Marijuana: What’s the Difference?
Hemp and marijuana come from the same plant species, Cannabis sativa, but they’re legally classified based on THC content.
- Hemp: Cultivated to produce lower THC levels and federally legal.
- Marijuana: Cultivated for higher THC levels and federally restricted.
While hemp and marijuana are legally distinct, the THC they produce is molecularly identical, delivering the same psychoactive effects.
But Isn’t Hemp Only Used for Rope and Fabric?
No! The 2018 Farm Bill legally redefined hemp based on its THC content. While some hemp varieties are grown for fiber and industrial purposes, others are cultivated specifically for their cannabinoids, like CBD and THC.
Legally, any cannabis plant with less than 0.3% THC is classified as hemp, regardless of how it looks or its intended use. This means that tall, fibrous plants used for textiles and short, resinous plants with traditional dense and tasty buds can both be considered hemp under federal law.
The variety of hemp plants we use for our products look, smell, and taste just like marijuana. The only difference? What Does “Delta” Mean?
The term “Delta” in Delta-9 THC, Delta-8 THC, and other variations simply refers to the placement of a double bond in the THC molecule’s carbon chain. It’s not a brand name or a marketing term. It’s a scientific classification used in chemistry.
In organic chemistry, the Greek letter Δ (Delta) is commonly used to indicate the position of a double bond within a molecular structure. For THC:
- Delta-9 THC (Δ9-THC) means the double bond is located on the 9th carbon chain of the molecule.
- Delta-8 THC (Δ8-THC) means the double bond is located on the 8th carbon chain of the molecule.
This small shift in structure alters how the molecule interacts with cannabinoid receptors in the body, but both compounds still produce psychoactive effects.
Delta Does Not Mean Fake: Some people mistakenly believe that anything labeled “Delta” is synthetic or inferior, but this isn’t true. “Delta” is just a descriptor for the molecular structure.
Why Does This Matter?
- Delta-9 THC is the Traditional THC: The full name of the THC molecule that has been used for centuries is Delta-9 Tetrahydrocannabinol. Over time, it was simply referred to as THC. However, when Delta-8 THC rose to popularity in 2021, a distinction became necessary. To avoid confusion, the term Delta-9 was reintroduced to clarify that it refers to the traditional form of THC that has been present in cannabis since human kind first lit up.
- Delta-8 THC is Chemically Converted: While Delta-8 occurs naturally in cannabis, it’s found in extremely small amounts, leading all Delta-8 products to be synthesized from CBD through a chemical conversion process. D8 typically has less pronounced effects than D9 and has been associated with side effects like headaches in some users.
But if D8 can be synthesized, can D9?
Yes, unfortunately most companies on the market do synthesize their D9. They do this to cut costs. By chemically synthesizing their D9 THC from CBD instead of extracting it naturally from hemp plants they save lots of money but also create an inferior product.
This process is similar to how D8 is created. While this process may be cheaper, it raises serious concerns:
- Purity Issues: Synthetic THC can often contain unknown isomers. An isomer is a molecule that has the same chemical formula as another molecule but a different structure or arrangement of atoms. This structural difference can lead to variations in how the molecules behave inside your body.
- Safety Risks: The chemical processes involved can introduce impurities, leaving consumers with a less reliable and potentially unsafe product.
- Compromised Quality: Synthetic THC may still be Delta-9, but it may be a version of D9 that reacts differently and less consistently in humans than naturally extracted D9
What does 10:1 mean?
The 10:1 ratio refers to the balance of CBD to THC in a product, meaning for every milligram of THC there is 10mg of CBD. Utah requires this ratio in all cannabis products derived from hemp.
With higher CBD content, the intoxicating effects of THC are naturally rounded, making the experience more functional and enjoyable. CBD does not lessen the effects of THC. It simply makes them less “sharp.”
